Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.

In her order, the court pointed out that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

Terms of Freedom

The court, who was overseeing his challenge to removal in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
